Nirbhaya rape case: Tihar jail challenges ban on hanging of convicts, hearing in HC today

The Tihar Jail authorities on Saturday moved the Delhi High Court challenging the trial court order prohibiting the execution of four convicts in the 2012 Nirbhaya gang rape and murder case. The petition was presented before Chief Justice DN Patel for immediate hearing. It will be heard today. Jail authorities have challenged Friday’s order of the lower court in which Tamil was adjourned till further orders on the death sentence of the convicts. The culprits were to be hanged on Saturday.

On the other hand, President Ramnath Kovind has dismissed the mercy plea of ​​convict Vinay Kumar Sharma on Friday. Sharma’s lawyer had said that his client had filed a mercy petition before the President on Wednesday. Officials said that the President has rejected this mercy petition. On the other hand, convict Akshay Thakur filed a mercy petition on Saturday. Thakur and three other convicts were to be hanged earlier on Saturday but a court here postponed it indefinitely.

Hanging of Nirbhaya’s culprits postponed indefinitely
On Friday, Additional Sessions Judge Dharmendra Rana, based in Patiala House Court, has given this order considering the application seeking stay of the ‘death warrant’ issued by the convicts for hanging. Advocate A.P. on behalf of convicts Vinay Sharma, Akshay Singh and Pawan Gupta Singh told the court that his client had several legal options at present, so that the death warrant issued for hanging should be stayed indefinitely. However, the Tihar Jail administration opposed this demand of the culprits. The jail management told the court that the culprits could be hanged separately. After hearing all the parties, the court stayed the death warrant issued for hanging indefinitely. Also provided a copy of the order to the convicts and the jail authorities. The court ordered the jail administration to ensure compliance with this order and present the report on Saturday.


January 7, 2020: When the death order was issued for hanging, the court issued a death warrant and ordered the hanging of Nirbhaya’s criminals Mukesh Singh, Vinay Sharma, Akshay Singh and Pawan Gupta at 7 am on January 22.
January 17, 2020: Court re-orders and changes the execution date. Adatal again issued a death warrant, ordering all the culprits to be hanged at 6 am on February 1.


This was the case on
the night of December 16, 2012 in Basant Vihar area, a 23-year-old paramedical student was gang-raped in a very brutal manner in a moving bus. After this heinous incident, the government took the victim to Singapore for treatment where he died during treatment. In this case, the Delhi Police arrested six people, including the bus driver. They also included a minor. In this case the minor was released after being kept in a correctional home for three years. While one of the charges Ram Singh committed suicide in jail. The Fast Track Court court convicted four accused Pawan, Akshay, Vinay and Mukesh in the case and sentenced them to death. This decision of the fast track court was also upheld by the High Court and the Supreme Court.
